how to claim refund seller has not dispatched the product after third day of payment

I have purchased gopro hero4 black on 27th may 2 pm on eBay. I took decision on the basis of delivery by 1 June and refund will be claimed if the seller does not ship the product with in 3 days. Today the third day is over excluding 27th seller still has not shipped the product. Tried to contact him by all means there is no respons. Even eBay customer team is on his side. Told me to wait he is a good seller you will get the product. What's the fun if I am not able to take it on vacation for which I have spent 34000. Paisa pay gaurantee date you are automatically entitled for refund if the seller does not ship the product within three days. I want my money back there is no fun of spending so much if one can not use it for which it has been purchased.
