My Claim ID *** has not been solved by seller *** . What will I do?

I paid the price of Rs.349 for one 'Premium Trousre Fabric by Gwalior (Color ; Worsted Golden)' on 21.09.2013 for item no. ***. I did not get the delivery of the item in one month. I sent mail to the seller '***'. The seller falsely replied that the deliveryman could not find me in my address with repeated attempts. I stay in the heart of the town in a landmark building. I have verified from the website of 'The Professional Courier' website for the consignment no. BHL104950 and it has been shown  as 'On Transit'. Is it a cheating transaction of eBay?
