I won a Nokia 6681 on the 24th of December 2005, I made the payment by credit card, and the payment was approved on the 28th of December 2005. The seller is one Noor Mohammad Patel (finecollection_in1) from Mumbai. I had called him atleast 20 to 25 times. Initially he said he will be dispatching the item on the 1st week of January, then he said he had dispatched the item and said he will give me the dispatch details, but did not give it to me for almost 2 weeks, meanwhile I was in touch with him. 2 weeks have passed now he tells me that the shipment has come back to him and he will be dispatching it again, in 1 or 2 days but he has not dispatched it till today. I have recieved 3 shipments bought from eBay intact. the items are 2 from Delhi and 1 from Cananda.

Purchase Protection Programs
Most purchases on eBay are protected by one of the following programs:
eBay Standard Purchase Protection Program - Most other items are covered up to Rs. 10000 (minus a Rs. 50 processing fee) under our buyer protection program.
If you need to file a claim, remember to stay within the program's timeframes and to follow all the recommended steps.
When am I covered under these programs?
This programs offer protection when you pay for an item that you don't receive, or receive an item that is substantially different than what was described in the listing. In addition, the following eligibility rules apply:
You must purchase the item on eBay.
Only tangible items (physical goods that are shipped) are covered. Services and intangible items such as emailed recipes, e-books, etc. are not covered.
You may only file one claim for each purchase. eBay's buyer protection program allows 3 claims per user, per 6 months.
The programs do not cover any item paid for using cash or instant money transfer. Bank-to-bank or post office wire transfers (both of which produce receipts with bank account numbers for both buyer and seller) are covered by the eBay Standard Purchase Protection Program.

Tell him if you dont get a refund you will leave very bad feedback which will affect his next chance to sell on ebay,call the ebay 1-800 number and ask customer support what legal actions can be takeing if your money or item dose not arrive in a timely maner.
