who is responsible if the seller not sending item. both are fake on customer.

Dear Ebey  I am the valuable customer from your site but. but few time left you are listing a fake seller on your site and I am sure you are involving for this activity. because I have bought  a Samsung galaxy s4 from your site. when I talk the seller. he told me I am not sending your product or lots of type abusing word to giving us. but I know ebey because this is the ebey wander. I am going on consumer court or regarding my issue.
