ebay favouring fraudster seller and robbing innocent buyers

Purchase details: Air-U-Space 5 in 1 Sofa bed PLUS FREE GIFT (#120536231338) sold to revathir on 22-Mar-2010 from seller just_4_u_no.1
Cost: Approx Rs. 4000

I purchased the above mentioned product recently and the item arrived as a damaged/unusable piece. I tried contacting the seller to communicate the issue but he was not reachable. I reported the problem through ebay along with photographs. The seller got back saying that he will neither replace nor refund the defective piece as I had reported the issue late(The item was supposed to reach me by 11Apr10 as per the seller's update in the system and I reported the issue on 6Apr10. Still not clear on how this could be a delayed reporting?). Following this conflict, I logged a negative feedback on the fraudster seller. What happened after that was totally unbelievable!!! ebay rejected my refund/replacement request and removed the feedback I had given on the seller for no reason.

Inspite of my concern being genuine, I was denied refund/replacement by seller, ebay rejected my refund request and even my feedback on the seller has been removed for whatsoever reason. This is completely a biased decision and I have no clarity on what was my mistake in this whole episode. I lost Rs 4000 and I have a defective piece which is unusable and I have no authority to even voice my feedback on the fraudster seller through the ebay feedback forum.

Would like to understand where I should send the defective sofa as I have no use for it(It arrived as a defective piece). Probably both ebay and the fraudster seller can sell this defective piece to another innocent buyer and make some more money.

Would appeal to the community to help me by suggesting what I can possibly do now that I have been robbed off Rs. 4000 and ebay is completely biased towards/favouring the fraudster seller for reasons not very clear to me.

Thanks much for the suggestion.

Tried that. No response from ebay till date. Is there anything else I can do? Its huge money(one of the costliest I bought via ebay in the last 6 years) and I am just not able to digest the fact that I lost such a huge some of money to a fraudster (I would be more than happy if I had given this money for charity) and ebay is favouring the fraudster seller for no reason. Totally unfair!!

Would you be able to suggest any email IDs of ebay where I can escalate this concern. Or is there anything else I should be doing to make my problem heard by the right authorities. Would it be advisable to take this up with the consumer court?

Raised a claim and ebay responded after 8 days asking me to ship the product 'through a eputed courier company' to the seller. There is no clarity on whether I would get a refund or replacement but I am being asked to spend 500 Rs from my pocket to send the product back. So effectively I lose the money paid for the item(Approx. 3500) and lose the shipping costs(back and forth - 500+500=1000Rs) which is totally unfair.

I have provided you with all the links, why don't you read for yourself what your rights are and what you will get. I know in what state of mind you are now but please keep your cool and think clearly. I think you are just being too hasty in this matter.

When you filed case under "EBAY GUARANTEE PROGRAM" it asks you clearly if you want refund or replacement, then how do you say "what will happen". When ebay has asked you to return the defective goods back please send it back to the seller and email the proof of dispatch copy to ebay at the given email address. Please read the Guarantee program terms carefully, even your dipstach cost will be reimbursed back to you by ebay, but please read properly first.

You will have to keep your presence of mind.
