Buyer's rights re defects not mentioned in item description ?

Take a hypothetical situation : A buyer receives a used item that has a serious defect. The seller did not mention the defect in his listing, but also did not specifically say that the item is in perfect condition.

To give more specific (hypothetical) examples - suppose a camera has a deep scratch in the lens that degrades image quality, or a computer part that is not completely dead but does not work properly (say, a graphics card that keeps crashing even when set up properly) - that kind of thing.

If the seller is not cooperative in such cases, is the buyer entitled to some compensatory action from eBay ? Or will filing a complaint be just a waste of time ?

Hello Pimpom (is that your nickname!)

I think you or someone close to you is presently facing this kina problem, isn't it! Well, if you can mention your specific case it will be worth explaining, since I believe every situation is very different from others and has its own specific points ๐Ÿ˜ฎ

Now, lets explain your 'hypothetical' problem regarding the Graphics Card. Lets say, the seller did not mention that the Card was faulty but also didn't say it WORKS PERFECTLY. The buyer did not pay attention to small phrases in the listing eg. 'like new', 'as is', 'just fine' etc. He also didn't like asking too many questions to the seller (becoz tht ud make him talkative :^O).
And finally after receiving the card he discovers that either there is no fan, or the PCB is poor condition, or maybe the card was fine but has been damaged due to lack of anti-static protection while handling ๐Ÿ˜ž

In short, you cannot play games! X-(

In such situations, if all other replies are negative,
the best way would be to ask your seller politely for a partial refund. ๐Ÿ˜„

If you report to eBay India (item bought from eBay.in) I am unsure whether you'll get help unless you can convince them (if ever you get a chance to) that its not YOUR fault. Provide visual-proof supporting every statement of yours & copies of email communications between the seller and you, for references. eBay has also recently started some Third-party arbitration (at an extra fees).
