Fraud and defective neck pillow

I purchased 3 neck pillows through e-bay and netshoppings phone number ***, The pillows were defective and the stitching came apart when they were delivered. I informed the seller and opened a claim No. ***for paisa pay ID ***on 5th May 2013, the very day I recieved the package. I left for USA thereafter asking for a refund and that I was willing to return the defective package on my return. To my surprise E-bay has closed the case and given this buyer my money. I sent several emails to them, and talked to their customer support. eBay is a fraud organisation and supports crooks. The buyer has vanished and does not answer my calls. I am now exploring the option of filing a case with the consumer court. NEVER BUY FROM EBAY.
