Claim closed unfairly

I purchased two voltage stabilizers having invoice value RS 12,980/-
One works perfectly while the other was defective from day one.
The seller says invoke warranty and request manufacturer to repair.
 
Now, no customer will pay for a defective product. If the product turns defective after some use, yes, I will invoke warranty but not if it was defective from day one
 
I raised a claim and requested replacement. The claim was suo motu closed by ebay stating that my claim was not tenable as product is under warranty. Does this seem fair to you? Meanwhile there is absolutely no response from the manufacturer. Is it okay for sellers free to sell defective goods at MRP on ebay? What is the customer to do with this defective item? 
 
Can Mr. Vidmay Naini please respond to this?

In case you are curious, these were Microtek EM4090+ 4KVA Digital Voltage Stabilizers for AC up to 1.5 Ton(90V-300V). One of them works fine the other cuts off voltage the moment it drops to below 190 Volts (instead of 90 volts).  Both these stabilizers make loud sound (poor quality relays) when rectifing voltage fluctuations .. guaranteed to give you sleepless nights...just the opposite of what you wanted.
