dispute raised on 14th sep2012, ebay called me only on 9 oct2012 and telling you have used the item hence no waarranty exist/ in between no communication\ after long gap what can i do?/ it is a fate of any ebay customer/it can happen to a long time ebay customer what is the fate of a new customer/ as ebay customer service say they only help & dispute should be resloved by the parties Then what is the responsibility of ebay I LOST FAITH IN EBAY transactions this is my 3rd dispute i am not happy with the way ebay is dealing the disputes

Had you contacted the seller first instead of raising dispute directly with eBay?

Sellers these days solve 99.9% genuine problems faced by buyers.

You should have return the item to buyer immediately with declaration on RETURN form specifying the item inside. So, that after successfully returning the item to seller, your seller could have given you immediate replacement or money back.
