Deny a claim due to delay in responding to already lodged complaint

Can ebay take it as its right to deny a claim that was already lodged for but delay in responding to subsequent query from them to seek re-clarification of the nature of failure of service?

 

Just read and give your comments whether ebay can be reliable e-commerce site or not?

 

I have ordered for item code: 351064243782 and received item code: 351064228840, within 3 days lodged complaint over phone and it has been taken up. The had sent email quesry seeking clarification on nature of wrong product delivery. It some time to even to trace the item code from their site as well I was on long tour; by the time 7 days over and ebay have closed my case.

 

I am not asking refund of my money, I only ask for replacement of my ordered product.

 

Shall I take up with consumer redressal forum as they have to follow the rules of the land since the transaction has taken place in India.
