Want to return an Item that is in used condition, Do I need a lawyer for that ?

Do I need to go to consumer court to return a Ebay Guarantee covered Item ?I have contacted ebay and the seller, both are not taking any action. I just want my money back and return the item as I ordered a new item and it came in used condition.
