GST Implication on International selling from India

Hi!!

 

As we are getting messages from ebay India that we need to register ourselves under GST as the same will be applicable from 1st July,I would like to know whether GST Registration is mandatory for selling on www.ebay.com from India?

 

Can someone please help me on this?

If you list your item on ebay.COM -  Relax! you don't need a GST and you are not liable or even eligible for GST for cross border trading. Your account will not closed. Simply becase GST is applicable to products or services sold within India ONLY.

 

If you list your items on ebay.IN - Yes, you better get a GST.

But according to GST, all international sales shall be treated as INTRA - State sales that is sale between two states of India. So ecommerce operators should give/deduct tax on products/services sold/provided. But according to constitution of India there should be NO tax on exports (goods send to other countries) and this clearly is tax on export. To overcome this discrepancy, GST says all the tax charged on export will be returned after formalities. This means GST number is necessary  for selling on ebay.com or any other ebay international site.

 

Just take ebay India model - Ebay india model is different from most of the big e-commerce operators in India where they receive the money and then pass to the seller. Ebay with paisapay is same type of platform but where seller receives payment from buyer through DD/Bank tarnsfer or any other way, how could it is possible for ebay to deduct half or one percent tax (add it to the fee ?). No it is not GST. For international sale on ebay.com etc, it is more confusing. Ebay india has no control over the money we receive in our paypal accounts by selling on ebay.com. It is also difficult for ebay.com as ebay and paypal are separate companies now.

 

Truth is - people who are making GST and law for e-commerce operators do not understand ebay model and ebay india has to necessarily ask for GST number from its sellers because govt told them to do so. Ebay india (or anybody who oppose it) can only argue against it in the court. It will be not be surprising if we see suspensions of numerous seller's paisapay and then ebay accounts after 25th June (those who dont have GST registartion).

They are holding the money illegally for previous orders received in May and June 2017 where as GST is from 1st of July 2017. So first allowing sales and now blocking payment to small innocent sellers. eBay India should be sued for harassing sellers.

eBay India that is eBay.in also removed all listing in the middle of listing agreement period on 25th June 2017. This is totally illegal. When sellers paying you for one week listing, how can you stop in middle? This is totally violations. eBay India should be booked under serious case. Report this to govt of Maharashtra. And also complaint with Central government of India. There are thousands of small sellers who sold small and used item or sell new items as part-time small business are now in danger situation. If they want to block payment why allowed ads and sales? Honest question. Now they are saying money will be held with them? What if small and poor vendor sell items with small margin hope and total money is looted by this inhumane eBay India staff. This is very serious issue. Sellers should knock government door for help.

You have given absolutely incorrect information.

The above is true only for Imports and not for Exports.

 

"To overcome this discrepancy, GST says all the tax charged on export will be returned after formalities. "

 

This is also applicable for claiming refund of duty paid on Imports.

 

 

NO GST IS PAYABLE ON EXPORTS. FOR GST PURPOSES, ALL EXPORTS WILL BE CONSIDERED ZERO VALUE I.E. NULL.
