why ebay system accepting claim even if buyer has not received the item ?

I have generated claim Id on the next day after ordering the item, as i do not want to recive the item because feedback for that item was not good. Ebay has generate the claim ID and rejecting the claim by saying that you are not entitled for refund of product and ebay gaurantee does not apply because you have not received the item. after receiving the item ebay system has not accepted my claim, as i was not able to raise theclaim, reason was i already claim one time so you are not entitled for second time claim, so inspite of my NO for the item they have deliver that item and not gave the ebay 30 days refund gaurantee because i already claim which was not valid first time. so first time system has no right  to generate the number if  ebay gaurantee doesnot fall under that period. I will surely write to consumer forum and file a court case against this ebay policy and not giving the refund to customer even if customer do not want that item.
