Loophole in ebay policy for buyers

Ebay policy says that a refund claim has to be filed withn 30 days of receving the order. What if the seller deliberately delays you from filing the claim? 

 

This happened with me. I ordered an air pump with "car n more". It was broken so I contacted seller directly to replace it. Seller told me that he is out of office and will contact me soon. When he finally contacted me, he told me that it's too late now and replacement or refund is not possible. So I filed a refund claim with ebay but ebay rejected it because the claim was filed after 30 days of getting the product. 

 

Ebay cannot see beyond its policies and the seller (car n more) succeeded in sending me a broken product and then causing delay so that I cannot get refund from ebay.
