Got handset with counterfeited touch screen, e bay also closed the claim

Got handset with counterfeited touch screen from seller, stopped working after few days operation, submitted to Nokia care centre for waurantee, Nokia centre refused to give the warranty saying handset touch found counterfeited so out of warranty and returned without repair, e bay also closed the claim and said that claim falls under non-eligibility criteria though the claim was filed within a month period time of receiving the item.

 

What is the way out for such cheating?? I am planning to go legal and preparing/ compiling all the data related to purchase/ communication in order to file the case in consumer forum...
